Terms of service

Welcome to Meshality, a brand of Brainstorm Corporation ("Meshality," "we," "us," or "our"). Meshality makes custom, full-color 3D-printed keepsakes and models under the brands MiniMemories (figurines of people), TailKeeps (figurines of pets) and Meshality Studio (custom 3D prints from your own model files). These Terms of Service ("Terms") govern your use of meshality.com, tailkeeps.com, minimemories.com, the Meshality Studio, our partner program and everything we make for you (together, the "Services"). By using the Services you agree to these Terms and to our Privacy Policy and Refund & Guarantee Policy, which are part of these Terms. If you do not agree, please do not use the Services.

1. Who can use the Services

You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. You agree to give us accurate information and to keep your account details private. You are responsible for what happens under your account; tell us right away at support@meshality.com if you think someone else is using it.

2. How ordering works

MiniMemories and TailKeeps. You upload photos or a short video. Our team builds a 3D model from them, and you preview it before anything is printed. You can ask for revisions until you are happy with the model, then approve it and choose a print size. Nothing is printed until you approve the model. Prices are shown in U.S. dollars when you choose a size; shipping is added at checkout at the rate shown there. From your upload to a figurine at your door typically takes three to four weeks; the timing shown in the Studio and in your order emails is an estimate, not a promise, because every piece is made to order and hand-finished.

Meshality Studio custom prints. You upload a 3D model file and we quote and print it. You are responsible for the quality and printability of files you supply; we will tell you if a file cannot be printed well, but we are not responsible for results caused by the file itself (broken geometry, walls that are too thin, low-resolution textures, and the like).

Approval is the point of no return. Once you approve a model and we begin printing, the piece is made specifically for you and cannot be cancelled. Before approval you can cancel at any time and anything you have paid is refunded. After delivery, our Refund & Guarantee Policy applies.

Made-to-order tolerances. Full-color 3D prints are accurate to within about ±0.5 mm or 2% of a dimension, whichever is greater, and colors can differ slightly from a screen. Small variations within those limits are normal and are not defects.

3. Your photos, videos and files

You keep every right you have in the photos, videos and files you upload. You give Meshality a limited, non-exclusive, royalty-free license to store, copy and process them, and the 3D models we make from them, only to make and deliver your order, provide support, and keep your account working (for example, so you can reorder). We do not use your uploads for advertising, and we do not sell them.

By uploading, you confirm that:

  • you took the photos or video, or you have permission from whoever did;
  • every person shown has given you permission to have a figurine made of them, or is your child or dependent (if a person shown is under 18, you are their parent or legal guardian);
  • nothing you upload infringes anyone's copyright, trademark, privacy or publicity rights.

We may decline or cancel an order if we believe an upload breaks these rules, and we will refund anything you have paid for it.

4. What we will not make

We do not print weapons or weapon parts, items that are illegal to make or own, counterfeit or infringing goods, sexual content, or content that harasses or threatens a person. We may refuse any order, and we may report illegal requests to the authorities.

5. Copyright complaints (DMCA)

We respect the intellectual property of others and expect the same from our customers. If you believe something on our Services or in an order infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent:

Your notice must include: the copyrighted work you say is infringed; where the infringing material is (a link or an order number); your name, address, phone and email; a statement that you believe in good faith the use is not authorized by the copyright owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We remove or disable material we reasonably believe infringes, we notify the person who uploaded it, and they may send a counter-notice. We close the accounts of repeat infringers.

6. Partner program

Creators we invite (or who apply) can join the TailKeeps or MiniMemories partner program. These extra terms apply to partners:

  • What you get. A free figurine made from your photos or video, a personal link and code, a commission (currently 20%) on every sale made through your link or code for as long as you are a partner, and a discount (currently 15%) for your followers. Commissions are tracked and paid through our partner dashboard, and the dashboard's payout terms apply.
  • Say it was gifted. Because your figurine is a gift and you earn a commission, U.S. Federal Trade Commission rules require you to disclose that relationship clearly in every post, video, story or message about it — for example "#ad", "#gifted" or "I'm a TailKeeps partner", placed where people will actually see it, not buried in hashtags. You agree to do this, to say only what you honestly think and have experienced, and to make no claims about our products that we have not made ourselves.
  • Your content. You own what you create. You give Meshality permission to reshare and repost the content you publish about your figurine, on our own channels and website, with credit to you. Tell us at partners@meshality.com if you want a piece taken down and we will remove it from our channels.
  • Playing fair. No spamming your link, no bidding on our brand names in search ads, no coupon-site posting, no self-referrals. We may pause or end a partnership at any time for any of these, and either of us may end it for any reason; commissions already earned stay payable under the dashboard's terms.
  • Email from us. We may write to you about the program. Every message tells you how to stop them; replying "no thanks" is enough.

7. Our content

The Services, our website, brand names, logos, photos of finished pieces and the models we build (before you approve and buy them) are ours or our licensors' and are protected by intellectual property laws. Please do not copy or reuse them without written permission. You may of course share photos of the figurine we made for you however you like.

8. Warranties and limits on liability

We make everything by hand and stand behind it — see our Refund & Guarantee Policy. Beyond that policy, the Services are provided "as is" and, to the extent the law allows, we disclaim implied warranties of merchantability and fitness for a particular purpose. To the extent the law allows, Meshality is not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order (or $100 if you paid nothing). Some states do not allow these limits, so some may not apply to you.

9. Indemnity

You agree to defend and indemnify Meshality and its people against claims and costs (including reasonable attorneys' fees) that arise from your uploads, your breach of these Terms, or your violation of anyone's rights.

10. Ending things

You can close your account at any time by writing to support@meshality.com. We may suspend or close an account that breaks these Terms or is used fraudulently. Sections 3, 5, 7, 8, 9 and 11 survive any termination.

11. Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If we have a problem, please write to us first — most things can be sorted out in a few emails. If we cannot resolve a dispute within 60 days, it will be resolved by binding individual arbitration administered by JAMS under its streamlined rules, in San Bernardino County, California, or by video, and not in a class or representative action. Either of us may instead bring an individual claim in small-claims court. You may opt out of arbitration by emailing support@meshality.com within 30 days of first accepting these Terms. Nothing here limits rights that cannot be waived under your state's law.

12. Changes to these Terms

We may update these Terms. We will post the new version here with a new date and, for material changes, email account holders. Using the Services after a change means you accept it.
