Welcome to Chroma 3D Printing ("Chroma," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, services, and any related applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, INCLUDING LIMITATIONS OF LIABILITY AND A BINDING ARBITRATION CLAUSE.

1. Acceptance of Terms

By accessing our website, uploading files, requesting quotes, placing orders, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Quality Guarantee Policy, which are incorporated herein by reference.

We reserve the right to modify these Terms at any time. Your continued use of the Services following any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.

2. Services Description

Chroma provides professional full-color 3D printing services, including but not limited to:

  • Full-color 3D printing using advanced additive manufacturing technology
  • File processing and optimization recommendations
  • Instant quote generation based on uploaded 3D model files
  • Quality finishing services including our proprietary clear coat process
  • Shipping and delivery of completed prints

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using our Services under applicable law
  • Provide accurate and complete information when creating an account or placing orders

By using our Services, you represent and warrant that you meet all eligibility requirements.

4. User Accounts

While accounts are not required for basic quote requests, creating an account enables additional features such as order history and saved preferences.

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring all information provided is accurate and current

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5. Orders & Pricing

5.1 Pricing

All prices displayed on our website are in United States Dollars (USD) and are subject to change without notice. Prices are calculated based on model volume, complexity, quantity, and selected turnaround time.

Volume discounts are applied automatically:

  • 10-24 units: 10% discount
  • 25-49 units: 15% discount
  • 50+ units: 20% discount

Rush fees apply for expedited turnaround:

  • Rush (3-4 business days): +25%
  • Express (48 hours): +50%

5.2 Order Acceptance

Your submission of an order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason, including but not limited to:

  • Pricing or product description errors
  • File quality issues that cannot be resolved
  • Suspected fraudulent activity
  • Violation of our Prohibited Content policy
  • Production capacity limitations

5.3 Payment

Payment is due at the time of order confirmation. We accept major credit cards, PayPal, and bank transfers for qualifying orders. All payments are processed securely through third-party payment processors.

You agree to pay all charges incurred in connection with your order, including applicable taxes and shipping fees.

5.4 Order Cancellation

Orders may be cancelled within 2 hours of placement for a full refund. After production has begun, orders cannot be cancelled, and no refund will be issued except as provided in our Quality Guarantee.

6. File Requirements & Customer Responsibilities

6.1 Accepted File Formats

We accept the following 3D file formats: STL, OBJ, 3MF, and VRML. Files must not exceed 200MB in size.

6.2 File Quality Standards

IMPORTANT: THE CUSTOMER IS SOLELY RESPONSIBLE FOR THE QUALITY AND PRINTABILITY OF UPLOADED FILES.

For optimal results, files should meet the following specifications:

  • Manifold (watertight) mesh geometry
  • No inverted normals
  • Minimum wall thickness of 1mm
  • No intersecting or overlapping geometry
  • Proper UV mapping and texture files (if applicable)
  • Model dimensions within our maximum print size (300mm x 300mm x 300mm)

6.3 File Quality Disclaimer

CHROMA IS NOT RESPONSIBLE FOR PRINT QUALITY ISSUES RESULTING FROM:

  • Non-manifold or corrupted mesh geometry
  • Insufficient wall thickness
  • Poor texture resolution or improper UV mapping
  • Files generated by AI tools that do not meet printability standards
  • Design decisions made by the customer (proportions, detail level, etc.)
  • Files that were not optimized for 3D printing
  • Color specifications that cannot be accurately reproduced

While we may provide recommendations for file optimization, we are under no obligation to repair or modify customer files. Any file modifications performed by Chroma are done at our discretion and do not guarantee print quality.

6.4 File Validation

Our system performs basic automated file validation. However, passing automated validation does not guarantee that a file will print successfully or meet customer expectations. Final print quality is dependent on the quality of the source file.

7. Intellectual Property Rights

7.1 Your Content

You retain all intellectual property rights to the 3D model files you upload ("Your Content"). By uploading files to our Services, you grant Chroma a limited, non-exclusive, royalty-free license to:

  • Process, store, and manufacture Your Content solely for the purpose of fulfilling your order
  • Create backup copies for operational purposes
  • Display Your Content to you through our interface

This license terminates upon completion of your order and deletion of files from our systems, except as required for backup or legal compliance purposes.

7.2 Representation of Rights

BY UPLOADING FILES, YOU REPRESENT AND WARRANT THAT:

  • You own or have obtained all necessary rights, licenses, and permissions to use and reproduce the content
  • Your Content does not infringe any third-party intellectual property rights, including copyrights, trademarks, patents, or trade secrets
  • You have the right to grant the licenses described in these Terms
  • Your Content complies with all applicable laws and regulations

7.3 Third-Party IP Infringement

Chroma respects intellectual property rights and expects customers to do the same. We reserve the right to refuse any order that we believe, in our sole discretion, infringes upon third-party intellectual property rights.

We will respond to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA). Repeat infringers may have their accounts terminated.

7.4 Our Content

All content on our website, including text, graphics, logos, images, and software, is the property of Chroma or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Prohibited Content

YOU MAY NOT USE OUR SERVICES TO PRINT:

Weapons: Firearms, firearm components, ammunition, explosive devices, or any items designed to cause harm

Illegal Items: Drug paraphernalia, counterfeit goods, or any items prohibited by federal, state, or local law

Infringing Content: Items that violate copyrights, trademarks, patents, or other intellectual property rights without authorization

Harmful Content: Items intended to harass, threaten, or harm individuals or groups

Obscene Material: Child exploitation material or non-consensual intimate imagery

Fraudulent Items: Counterfeit currency, fake identification documents, or items intended to deceive

Regulated Items: Medical devices, food-contact items, or other regulated products without proper certification

We reserve the right to refuse any order and report suspected illegal activity to appropriate authorities. Violations may result in immediate account termination without refund.

9. Quality Guarantee & Limitations

9.1 What We Guarantee

We guarantee that prints produced from properly prepared files will:

  • Be free from manufacturing defects (layer separation, incomplete prints, machine errors)
  • Receive our proprietary clear coat finish
  • Be professionally packaged for safe shipping
  • Accurately reproduce the geometry of the source file within our stated tolerances

9.2 What We Do NOT Guarantee

OUR QUALITY GUARANTEE EXPRESSLY EXCLUDES:

  • Issues resulting from poor file quality, non-manifold geometry, or improper file preparation
  • Color variations from screen displays (monitors vary in color calibration)
  • Design decisions or aesthetic preferences
  • Fitness for any particular purpose beyond decorative display
  • Structural integrity under stress, impact, or load-bearing applications
  • Compatibility with paints, adhesives, or other post-processing materials
  • Damage occurring after delivery
  • Issues with files generated by third-party AI tools or software

9.3 Tolerances

All 3D printing processes have inherent tolerances. Our prints are accurate to within +/- 0.5mm or 2% of the dimension (whichever is greater). Minor variations within these tolerances are not considered defects.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

10.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10.2 Limitation of Damages

IN NO EVENT SHALL CHROMA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages arising from your use of or inability to use our Services
  • Any damages arising from unauthorized access to or alteration of your files
  • Any damages exceeding the amount paid for the specific order giving rise to the claim

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

10.3 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

10.4 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chroma, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you upload or submit through our Services
  • Any false representation or breach of warranty by you
  • Any claim that Your Content caused damage to a third party

We reserve the right to assume exclusive defense of any matter subject to indemnification by you, at your expense.

12. Shipping & Delivery

12.1 Shipping Terms

Standard US shipping is included in quoted prices. International shipping and expedited shipping options are available at additional cost.

Delivery timeframes are estimates and not guarantees. Turnaround times begin after order confirmation and payment, not from the time of file upload or quote request.

12.2 Risk of Loss

Risk of loss and title for items purchased pass to you upon delivery to the carrier. We are not responsible for delays, damage, or loss caused by carriers after shipment.

12.3 Shipping Damage

If your order arrives damaged, you must notify us within 48 hours of delivery with photographic evidence. Claims submitted after this period may not be honored.

12.4 Address Accuracy

You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by you. Re-shipping fees may apply.

13. Refunds & Returns

13.1 Manufacturing Defects

If your print has a verified manufacturing defect (as defined in our Quality Guarantee), we will, at our sole discretion:

  • Reprint the item at no additional cost, OR
  • Issue a full refund for the defective item

13.2 File Quality Issues

NO REFUNDS WILL BE ISSUED FOR PRINTS THAT ACCURATELY REPRODUCE A CUSTOMER'S FILE BUT DO NOT MEET CUSTOMER EXPECTATIONS DUE TO FILE QUALITY ISSUES.

13.3 Non-Refundable Items

The following are non-refundable:

  • Orders cancelled after production has begun
  • Prints that match the uploaded file specifications
  • Dissatisfaction with design choices made by the customer
  • Rush or express fees once expedited production has begun
  • Orders rejected due to Prohibited Content violations

13.4 Refund Process

Approved refunds will be processed within 10 business days to the original payment method. You are responsible for return shipping costs unless the return is due to our manufacturing error.

14. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Upon request by law enforcement or government agencies
  • Extended periods of inactivity
  • Technical or security issues
  • At our sole discretion for any reason

Upon termination, your right to use our Services ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Disputes & Arbitration

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Chroma agree that any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property infringement.

Arbitration shall be conducted by JAMS under its Comprehensive Arbitration Rules. The arbitration shall take place in San Bernardino County, California, unless otherwise agreed.

15.3 Class Action Waiver

YOU AND CHROMA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.4 Time Limitation

Any claim arising from or related to these Terms or our Services must be filed within one (1) year after the cause of action arises, or be permanently barred.

15.5 Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after any modifications constitutes acceptance of the modified Terms.

For material changes, we may provide additional notice via email to registered users. However, it is your responsibility to review these Terms periodically.
